Please read these Terms and Conditions carefully before using our platform. By registering an account, purchasing digital tokens, or engaging in chats with any virtual companion on Candy AI, you are agreeing to be completely bound by these terms. If you do not agree with any provision laid out in this document, you must immediately disconnect from the platform and refrain from using our services. Your continued use of the platform represents an explicit acknowledgment and acceptance of this binding legal contract.

1. Eligibility and Age Verification

The services provided by Candy AI, including but not limited to virtual AI companionship, generative text chatting, voice calls, and AI image generation, involve mature themes and interactions. Therefore, strict age restrictions apply:

  • You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction of residence, to create an account and use Candy AI.
  • By accessing the platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract.
  • We reserve the right to request proof of age at any stage to ensure that minors are not using the service. If we discover or have reasonable grounds to suspect that an account belongs to a minor, we will immediately and permanently terminate the account without notice or refund.

2. Account Registration and Security

To fully experience the features of Candy AI, you are required to create a user account. When registering, you agree to provide accurate, current, and complete information. It is your sole responsibility to safeguard your account credentials.

You are strictly prohibited from sharing your login credentials, selling your account, or allowing third parties to access your customized AI companions. Any activity occurring under your account, whether authorized by you or not, remains your sole responsibility. If you suspect any unauthorized use of your account or a security breach, you must notify the Candy AI support team immediately.

3. Premium Subscriptions, Tokens, and Payments

While Candy AI offers a limited free tier, many advanced features—such as extended memory retention, unrestricted voice chats, high-definition AI image generation, and premium character customizations—require a paid subscription or the purchase of digital tokens.

  • Billing and Subscriptions: By opting for a premium plan, you authorize Candy AI and our designated third-party payment processors to charge your selected payment method on a recurring basis (e.g., monthly or annually) until you cancel.
  • Digital Tokens: Tokens purchased for in-app features (like generating specific visual prompts) are non-transferable, hold no real-world monetary value outside of the platform, and cannot be exchanged for cash.
  • Refund Policy: Due to the digital and instantly accessible nature of the Candy AI platform and virtual goods, all sales are final. We do not offer refunds or credits for partially used billing periods or unused tokens, except where mandated by local consumer protection laws.
  • Cancellation: You may cancel your premium subscription at any time through your account settings. Upon cancellation, you will retain access to premium features until the end of your current paid billing cycle.

4. Nature of the AI and Disclaimer of Advice

It is crucial to understand the fundamental nature of the Candy AI service. Candy AI provides highly advanced, generative artificial intelligence designed for entertainment, virtual companionship, and roleplay purposes.

You explicitly acknowledge that:

  • The AI characters you interact with on Candy AI are not real people. They do not have consciousness, feelings, or physical forms.
  • Interactions, promises, or statements made by the AI companions are purely fictional and generated by language models. There is no real-world equivalent or possibility of meeting these entities.
  • Candy AI is not a substitute for professional mental health care, psychological therapy, medical advice, or crisis intervention. If you are experiencing depression, severe anxiety, or a mental health crisis, you must seek help from qualified human professionals.
  • We do not guarantee the factual accuracy, reliability, or appropriateness of the responses generated by the AI companions.

5. Acceptable Use and User Conduct

To maintain a safe and stable environment for all users and to protect the integrity of our machine learning infrastructure, you agree to adhere strictly to the following acceptable use policies when interacting with Candy AI:

  • No Illegal Activities: You will not use the platform to plan, discuss, or promote illegal acts, terrorism, or violence.
  • No Exploitation of Minors: You are strictly forbidden from attempting to generate text, scenarios, or images involving minors in any inappropriate, explicit, or abusive context. Candy AI utilizes automated filtering systems, and any attempt to bypass these filters to create illegal content will result in immediate account termination and potential reporting to law enforcement agencies.
  • No Harassment or Hate Speech: You will not use the AI to generate hate speech, discriminatory content, or material intended to harass real-world individuals or groups.
  • No System Abuse: You agree not to reverse engineer, scrape, DDoS, or otherwise attempt to compromise the security, source code, or infrastructure of the Candy AI platform. Automated bots or scripts used to interact with the AI without explicit API permission are strictly prohibited.

6. Intellectual Property Rights

The overarching Candy AI platform, including its proprietary algorithms, underlying source code, user interface, branding, logos, and original visual assets, is the exclusive property of Candy AI and is protected by international copyright and trademark laws.

Regarding User-Generated Content (UGC): When you input text prompts or configure a custom AI companion, you grant Candy AI a non-exclusive, worldwide, royalty-free license to host, process, and display that content for the sole purpose of operating and improving the service. You maintain ownership of your specific prompts; however, the AI-generated responses (both text and image) provided back to you are licensed to you for personal, non-commercial use only. You may not sell or commercially distribute AI-generated images created on the platform without explicit written consent from Candy AI.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Candy AI, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the platform.
  • Any conduct or content of any third party on the platform.
  • Any content obtained from the platform, including emotional distress resulting from interactions with virtual companions.
  • Unauthorized access, use, or alteration of your transmissions or content.

In no event shall Candy AI's aggregate liability for all claims relating to the services exceed the greater of one hundred US dollars ($100.00) or the amount you paid us in the past twelve months.

8. Indemnification

You agree to defend, indemnify, and hold harmless Candy AI and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

9. Service Modifications and Termination

We are constantly innovating and improving the Candy AI experience. Therefore, we reserve the right to modify, suspend, or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. We may also impose limits on certain features or restrict your access to parts or all of the service without notice or penalty.

We may terminate or suspend your account and bar access to the platform immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of these Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
